General Terms and Conditions for the online purchase of vouchers, swimming pool and sauna tickets, and for the online booking of classes/spa services and events

§ 1 Scope
The following General Terms and Conditions of Business shall exclusively apply to the business relationships between OBB GmbH and its customers according to the version valid at the time of placing the order. Any General Terms and Conditions of the customer which deviate from these provisions shall not be valid, unless OBB GmbH expressly consents to these in writing.
§ 2 Creation of a customer account
It is possible to purchase vouchers or tickets (single tickets) and book classes and events at https://shop.freizeitbad-stegermatt.de either by registering and creating a customer account, or as a guest without an account. Should a customer wish to create a customer account, they will be required to provide certain personal data and a password. The minimum age for registration is 18 years. After registering, the customer can log in with their email address and chosen password. Registration is only required once. For future orders, the customer can simply log in with their email address and chosen password.
§ 3 Technical steps and conclusion of contract
(1) The following technical steps shall lead to placement of an order: The customer can click on a service or product in the online shop (a voucher, ticket, event, class or spa service), personally configure it if desired and then select the preferred value of the voucher. In the next step, the selected product is placed into the shopping basket by clicking on the button ‘Add to shopping basket’. The quantity of products selected can be amended or one or more products removed from the shopping basket. An existing voucher can also be redeemed here using the corresponding voucher code.
After clicking on the button ‘Proceed to checkout’, the customer will be directed to the login area. If the customer has already created a customer account, they can log in with their email address and password.
If the customer has not created a customer account, they can either sign up and create and account or continue as a guest without registering. If the customer makes a purchase without registering, they must provide an invoice address containing the first name, surname, salutation, email address, street name, house number, postcode, city and country. If the customer has already created a customer account, the invoice and delivery address will already be visible in the customer's account. This can be modified by the customer if necessary.
The customer confirms their details by clicking on the button ‘Continue’.
The customer can then provide a delivery address that differs from the invoice address and continue the purchase process by clicking ‘Continue’. In the next step, the shipping method can be selected which involves delivery either via post or free shipping by email (print@home). The purchase process can then advance to the next stage by clicking on ‘Continue’. Single tickets can only be delivered using the print@home option.
In the next step, the customer is directed to the payment page where they can choose from three different payment methods: Credit card, Giropay or PayPal. The payment method can be selected and confirmed by clicking on ‘Continue’.
All details provided are then shown on the summary page and the customer can complete the order by confirming acceptance of the T&Cs and cancellation policy, then clicking ‘Buy’.
Depending on the payment method selected, the customer will be transferred to the corresponding payment provider to confirm the payment.
Once the payment has been successfully processed, a notification saying ‘Order successful’ will appear.

(2) OBB GmbH automatically sends an order confirmation by email upon placement of an order. The contract shall become effective upon receipt of this confirmation by the customer.
§ 4 Single tickets
(1) Customers can purchase single day tickets at a specific rate (hourly/day rate) through the online shop https://shop.freizeitbad-stegermatt.de. The rates for different areas are indicated in the online shop.
(2) Single tickets allow access to the selected area booked and for the allocated time slot chosen. Single tickets cannot be moved to different dates. Unused single tickets will expire without a refund unless OBB GmbH is at fault due to a breach of its contractual obligations or by reason of intentional or grossly negligent conduct on the part of OBB GmbH or its agents.
(3) Single tickets are automatically sent upon successful order placement and receipt of payment.
§ 5 Purchasing vouchers
(1) Customers can purchase vouchers of different values via the online shop. The minimum voucher value is 5 euros.
(2) Vouchers are sent upon successful order placement and receipt of payment.
(3) The voucher holder cannot expect services offered at the time of purchase to still be available when the voucher is redeemed. OBB GmbH reserves the right to make changes to its services offered at any time.
(4) To redeem the voucher in the OBB GmbH online shop, the voucher holder must enter the voucher code in the designated field before clicking on ‘Proceed to checkout’ from their shopping basket during the order process.
(5) Vouchers cannot be exchanged for cash, either in full or in part. Vouchers cannot be exchanged or refunded, notwithstanding the legal right of withdrawal.
§ 6 Booking events
(1) The events offered are subject to change and non-binding. Technical changes or deviations from the services depicted remain reserved.
§ 7 Booking spa services
OBB GmbH allows various spa services to be booked through the booking portal, however OBB GmbH itself is not a contractual partner. The contractual partner for spa treatments is made known to customers during the booking process.
§ 8 Booking swimming lessons and other classes
Classes cannot be booked using the OBB GmbH booking system. This system simply provides a link to the external providers. Contracts for swimming lessons and other classes are exclusively made with the relevant third party without the involvement of OBB GmbH.

§ 9 Prices, terms of payment, default
(1) The prices and fees listed on https://shop.freizeitbad-stegermatt.de are inclusive of VAT and do not include any costs for packaging and delivery.
(2) Payments for orders and bookings on https://shop.freizeitbad-stegermatt.de can be made using the payment methods offered during the ordering process. The ordering party may choose their preferred payment method.
(3) The customer will receive an invoice via email along with the order confirmation. The customer agrees to receive the invoice exclusively in electronic format. Payment of the invoice is due upon receipt.
(4) Should the customer be in default of payment as per the statutory provisions, OBB GmbH reserves the right to withdraw from the contract and/or block the voucher or ticket.
(5) In the case of a returned debit, the customer is obliged to reimburse OBB GmbH for the costs incurred in relation to this.
§ 10 Liability
(1) OBB GmbH shall be liable for intentional and gross negligence. OBB GmbH shall further be liable for the negligent breach of obligations, the performance of which first make the proper performance of the contract possible to begin with, the breach of which places achieving the contract purpose at risk and the observance of which customers generally rely upon.(hereinafter: ‘fundamental contractual obligations’). In the event of a breach of these fundamental contractual obligations, we shall only be liable for any foreseeable damages typical for this type of contract. We shall not be liable for any slightly negligent breach of contractual obligations.
(2) The above exclusions of liability do not apply in the event of injury to life, limb or health. Any liability under the German Product Liability Act shall remain unaffected.
(3) With the current state of technology, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. In this respect, we cannot be held liable for the constant, error-free and uninterrupted availability of our online booking system.
§ 11 Establishment and bathing rules
The establishment and bathing rules along with any supplemental clauses are clearly displayed in the reception area and can be viewed here[1]. The contract between the customer and OBB GmbH shall be subject to the statutory provisions.
§ 12 Data protection
Personal customer data shall be collected, processed and used by OBB GmbH in accordance with statutory provisions, particularly those of the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). § 13 Information about the EU dispute resolution platform
The European Commission provides a platform for online dispute resolution (ODR). The platform is available at http://ec.europa.eu/consumers/odr/.
§ 14 Information pursuant to Section 36 of the Consumer Dispute Resolution Act (VSBG)
OBB GmbH is neither willing nor obliged to participate in dispute settlement procedures before a consumer arbitration board.
§ 15 Place of jurisdiction
The place of jurisdiction and performance is Germany.
§ 16 Severability clause
Should individual clauses of these T&Cs become ineffective, this shall not affect the validity of the remaining provisions nor the contract as a whole. The relevant statutory provisions will apply in place of any invalid clause.
